I-601A Provisional Waiver in Phoenix
An Immigrant-Led Perspective on Provisional Waivers
A provisional waiver doesn’t stand alone. It must fit within a family visa strategy that accounts for unlawful presence, departure from the United States, and the required consular interview. At Essien Law Firm, we evaluate these connected issues when preparing a provisional unlawful presence waiver for Phoenix families.
Our work includes family petitions, consular processing, USCIS interview preparation, and document review. A personalized consultation allows us to assess case viability and explain the available legal options before we prepare an application. Principal Attorney Lelia Adams brings personal experience to this work: she navigated consular processing after her mother’s deportation and ultimately secured her mother’s U.S. citizenship.

What the Provisional Unlawful Presence Waiver Covers
Form I-601A allows certain visa applicants who are relatives of U.S. citizens or lawful permanent residents to request a provisional waiver before leaving for a consular interview. It addresses certain departure-triggered unlawful presence bars. More than 180 days of unlawful presence before departure can trigger a three-year bar to reentry, while one year or more can trigger a 10-year bar.
Eligibility generally requires the applicant to be physically present in the United States, be at least 17 years old when filing, and have a visa case pending with the Department of State. These threshold requirements aren’t the complete analysis. Immigration history, the applicable consular process, and other grounds of inadmissibility, meaning legal reasons a person may be denied admission, can affect whether the waiver is available.
Important distinctions include:
- Timing: We evaluate and file the application before the applicant leaves for the consular interview when departure-triggered unlawful presence bars are at issue.
- Scope: The waiver addresses qualifying unlawful presence issues, not every possible ground of inadmissibility.
- Different application: Form I-601 and Form I-601A have different eligibility and timing requirements, so they aren’t interchangeable waiver forms.

Preparing a Provisional Waiver for Phoenix Families
We prepare the waiver as one part of the complete consular process. Our assessment considers whether removal proceedings, a prior removal order, or other immigration history changes the available filing path. We also review the underlying family petition and the stage of Department of State processing.
Our preparation process covers:
- Initial assessment: We evaluate case viability, potential unlawful presence bars, qualifying-relative requirements, and available legal options.
- Immigration record review: We identify proceedings, prior orders, and other history that may affect waiver eligibility.
- Filing preparation: We thoroughly prepare and review USCIS and Department of State filings, including supporting documents.
- Consular preparation: We explain why departure and the required immigrant visa interview remain necessary after waiver approval.
For Phoenix-area families whose cases are processed in Mexico, visa processing takes place through the U.S. Consulate General in Ciudad Juárez. Careful document review helps prevent incomplete or inconsistent submissions and keeps the waiver application aligned with the family petition and consular case.
Our team provides timely updates and accessible legal guidance throughout the process. Direct attorney involvement and clear communication help families understand what comes next, which documents require review, and how the waiver fits into their longer-term immigration goals.
